PRIVACY POLICY
This policy describes how we collect, protect, use and share your personal information. Personal information is defined in the New Zealand Privacy Act 2020 as information about an identifiable individual and must be collected, held and used in accordance with the Act. This is our current Privacy Policy and may be updated from time to time on our website.
YOUR INFORMATION – HOW WE COLLECT AND HOLD IT
We may receive personal information about you when you purchase our products, use our services, use any of our websites, mobile apps or social media, enter into a contract with us, or otherwise interact with us.
Collection of personal data may arise in person, via our digital channels, by phone, email or other method.
Examples of direct collection of personal information are:
- Filling out our feedback form.
- Registering your product warranty or making a warranty claim.
- Using any of our website or app tools such as our product selector, completing post product selector or post purchase surveys or completing any product reviews (on or offline).
- Submitting an after-purchase enquiry.
- Entering competitions and promotions.
- Emailing, calling or contacting our customer service team or using our website contact message system.
- Filling in a credit application form or providing other personal information as part of a supply contract or other commercial transaction.
We may also collect personal information from third parties, for example where you have purchased our product we may receive personal information from the retailer or delivery provider in relation to your product purchase including for processing the order, delivery, or warranty purposes. We may also collect information if you interact with a third party in relation to our products or services, for example, from digital platforms such as third party review sites.
If you, or a business with which you are associated, are a commercial supplier or contractor to us or if we are a supplier or contractor to you/that business then we may also receive personal information about you directly or indirectly.
WHAT PERSONAL INFORMATION DO WE COLLECT?
Personal Information we collect and hold may include personal details such as name and contact details, products purchased, product elements (e.g. mattress size, comfort level, personal preferences and requirements), website usage, customer complaints and reviews, marketing information, general inquiries and other feedback. We also collect website use information (see “Use of cookies and web analytics” below for more information).
If you are a commercial supplier to or customer of The Comfort Group personal information may include names, addresses, contact details, credit history, personal references and other personal information relevant to our contractual relationship.
STORAGE AND SECURITY
We hold your personal information at our head office which is located at 41-71 Great South Road, Otahuhu, Auckland, New Zealand. Personal information can also be held at our other offices in New Zealand or at our related companies in New Zealand or Australia, or at storage facilities in New Zealand, Australia or overseas. The information is usually stored electronically on servers owned by us or third party data storage providers engaged by us. No data transmissions over the internet can be guaranteed as completely secure therefore we cannot warrant or guarantee the security of information transmitted from or to you, however once we receive your personal information we will use reasonable efforts to protect the security of your personal information.
USING AND DISCLOSING PERSONAL INFORMATION
We may use, process and disclose personal information for the primary purpose for which it is collected, for reasonably expected secondary purposes which are related to the primary purpose, and in other circumstances authorised by the Privacy Act 1993.
For example, we may use the personal information that you supply to us for the following purposes:
- attend to your purchase and after-purchase transactions and enquiries,
- personalise and improve your experience and relationship with us,
- provide you with details of our products and promotions or those of our affiliates, retailers and partners that we feel would be of interest to you,
- market our products to you either directly or through our retailers and distributors,
- request product reviews or carry out surveys regarding our products.
We may disclose personal information to:
- Our related companies and affiliates,
- Third parties such as our retailers and distributors, including in relation to your order for a product or to provide delivery services, if a warranty claim arises, or so they can provide marketing information about our goods and services to you,
- Our contractors and providers of goods and services, for example, courier and delivery companies, training and certification agencies, business support services (including for storage and handling of documents and data), information technology service providers,
- Marketing and promotion companies, social media and search engine companies such as Google and Facebook,
- Market research companies who undertake customer surveys for us, data and analytic service providers.
- Insurance companies and professional service firms providing services to us, such as legal, insurance or accountancy services.
- As required by law, such as regulatory agencies.
- Any other recipient notified to you at the time of collection or that you authorise.
The Comfort Group website may also contain links from or to third party sites where information practices may be different. For example, if you “click” on a banner advertisement or another company’s logo on our websites, the click may take you off our site. This includes links to and from other companies such as advertisers, sponsors, retailers and partners that we may have joined with to offer or provide you with any products, services, competitions or promotions. We and the other company may share your personal information and may use it to identify future promotional opportunities or to fulfil promotional or contractual obligations. The other party will have its own privacy notice and Privacy Act obligations which will apply once you are on the third party website.
We may also share aggregated anonymised information about visitors to our websites and social media with third parties including advertisers, business partners and sponsors to understand visitor trends and patterns and to manage and improve our service.
USE OF COOKIES AND WEBSITE ANALYTICS
Cookies are small text files that are placed in your browser by the websites you visit. They are widely used to help users navigate websites efficiently, to perform certain functions on the sites and/or to provide site owners with information about how their sites are used (e.g. web analytics).
We use cookies, web analytics and other current technology (ourselves or via our technology or web analytics providers) to assess information such as the areas of our website you choose to visit and the activities which you elect to participate in. This information may be used for the purposes of managing your account (if any) with us, promotion and marketing (including we or our retailers and distributors sending you tailored advertising about our products and services that we hope may interest you), business development, trend analysis, statistical information, and to improve your browsing experience.

If you configure your settings to disable session and certain persistent cookies, you may find that limits some of the functions on the websites you visit.
You may also be able to limit the extent to which you receive the tailored advertising from cookies on each device by changing your settings on the websites on which you receive tailored advertising (this is unlikely to prevent all advertising from pages you visit but may reduce specific targeted ads).
LINKS TO SOCIAL NETWORKING SERVICES
We use third party sites such as media and social networking services to help communicate our messages and give you the best experience. We may track your use of our pages and promotions on these sites including by use of cookies as noted above.
When you communicate with us using a third party site, that site may also collect your personal information for its own purposes and may track your use of our page or our link on their site and also any link they may display on our site. The third party sites have their own privacy policies which are independent of ours.
EMAIL AND OTHER ELECTRONIC COMMUNICATIONS
By subscribing to our email and/or text communications, or otherwise providing us with your email address and/or mobile number, you consent to receiving emails and/or texts which promote and market our products and services, or the products and services of others, from time to time. You can opt out of those communications at any stage by utilising the corresponding “unsubscribe” facility. Once you have unsubscribed from those email or text communications, we will take steps to remove you from the corresponding marketing list.
PERSONAL INFORMATION ABOUT OTHER PEOPLE
You must not provide us with personal information about another person unless you will be able to demonstrate the other person has given you authority to authorise us to collect, use and disclose the other person’s personal information for the purposes described in this Privacy Policy.
